North Carolina Drug Schedules
In North Carolina, the severity of a drug crime charge and the related penalties will depend on the amount of drugs found in your possession, your intent for the drugs, and the type of drug itself. Under Chapter 90 of the Controlled Substances Act, drugs are classified into six schedules. These schedules relate to the drug’s accepted medical use and its potential for dependency or abuse.
Schedule I: This includes drugs such as heroin, LSD, or hallucinogens. These drugs have the highest potential for abuse, and Schedule I drug charges can result in a felony charge, fines, and five to ten years in prison.
Schedule II: This includes drugs such as morphine, codeine, Percocet, and other opium-based narcotics. These drugs have a considerable potential for abuse, resulting in a $2,000 fine (for a misdemeanor) and up to two to ten years in prison (for a felony).
Schedule III: This includes drugs such as Tylenol and codeine-based cough suppressants. These drugs have a moderate potential for abuse, and charges can result in between two and five years in prison and potential fines.
Schedule IV: This includes drugs such as Valium and Librium. These drugs also have a moderate potential for abuse, and the penalties for a Schedule IV drug charge are the same as Schedule III.
Schedule V: This includes drugs that contain limited amounts of codeine or opium, such as Robitussin. Schedule V drugs have the lowest potential for abuse, but charges can still result in six months to five years in prison and potential fines.
Schedule VI: This includes drugs like marijuana and THC. Like Schedule V drugs, these have a low potential for abuse, but charges can result in fines and anywhere from 30 days to five years in prison, depending on the amount found in your possession.
If you have been charged with a drug crime in North Carolina, our experienced criminal defense attorney at Timothee Law Firm, PLLC can help you understand which drug schedule corresponds to your charge and build a defense to combat or minimize the allegations against you.
